Please read these Terms and Conditions before using the Glosty website, adding a hair service or booking any services online.

Welcome to the website of Glosty (“Website”, Company”, “we” or “us”). Your access to and use of this website and its services (“Services”), including publishing any information, texts, photos, graphics or other materials uploaded, downloaded or appeared on the Services (collectively “Content”) is governed by these terms and conditions (“Terms and Conditions”). By accessing or using the Services you agree to abide by these Terms and Conditions. Please read them carefully.

Basic

By using Glosty and services available on the website, you accept our Terms and Conditions and you agree to comply with them as a registered or non-registered user. If you do not agree with the Terms and Conditions, you must not use the Glosty website in any way.

You take responsibility for your use of the Services, for any Content you upload to the Services, and for any consequences thereof, including the use of your Content by other users and our third party partners. Any Content submitted, posted, or displayed by you will be viewed by other users of the Services and through third party services and websites. You should only display Content that you are comfortable sharing with others under these Terms.

Privacy

Glosty’s Privacy Policy explains how we collect and use the information provided. By using our Services, you agree that Glosty can treat such data in accordance with our Privacy Policy.

For Content that is covered by intellectual property rights (IP content), such as photos and videos, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, copy, reproduce, process, adapt, modify, transmit, publish, display and distribute such Content in any and all media or distribution methods. This license continues even if you stop using our Services (this relates mainly to the published Content).

As part of providing you the Services, we may send you service announcements, administrative messages and other information. You may opt out of some of those communications.

Account Registration

You may need a Glosty account (“Account”) in order to use some of our Services, including, but not limited to, creating and publishing articles, commenting on and reviewing services, making bookings etc. For creating an Account, you may be asked to provide certain registration details or other information. You will provide correct, current and complete information. You are responsible for any activity that happens on or through your Glosty Account. You will secure the confidentiality of your password. You will not allow anyone else accesses your account, or do anything else that might put at risk the security of your account. While selecting a username for your account, you agree that we may remove or reclaim it if we find it appropriate.

Users

If you are aged 18 years old and over, you may become a registered user at Glosty. As a registered user, you will have access to save your favourite services, make and cancel bookings, save your contact information, review services, and receive promotional information. As a non-registered user, you will have access to make bookings, but all other features will be restricted.

Hair Professionals (“Vendors”)

If you are aged 18 years old and over, you may become a Vendor at Glosty. As a Vendor, you will have access to create your profile and disclose your work information, offer bookable services and accept bookings through Glosty.

User Generated Content (“UGC”)

Registered users of the website and Vendors may post UGC to the website. Any UGC added by you to the website will be attributed to your user account, your username at Glosty or the username of your social media account. We reserve the right to refuse to publish or remove any UGC.

Safety

While accessing or using the Services you will not do any of the following:

  • request login information or access an account belonging to someone else;
  • access, or use non-public areas of the Services, Glosty’s computer systems, or the technical delivery systems of Glosty’s providers;
  • scan or test the vulnerability of any system or network or breach or circumvent any security;
  • post illegal commercial communications (such as spam);
  • collect users’ content or information, or otherwise access Glosty, using automated means;
  • upload viruses or other malicious code;
    use Glosty to undertake any unauthorized, misleading, malicious, or discriminatory activity;
  • promote or support any violations of this Terms and Conditions or our Privacy Policy.

Glosty will not tolerate an inappropriate or offensive language. Inappropriate or offensive language includes, but is not limited to, any language or content that is sexually oriented, sexually suggestive, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, bigoted, incites violence or other unlawful behaviour, or contains racially, ethnically or otherwise objectionable material of any kind.

Content that are considered to be inappropriate in this way or otherwise unlawful, may be deleted without prior notification. Comments and articles that are misleading and off-topic may also be deleted. Articles public under irrelevant Categories and Interests, may be deleted or modified to be categorized appropriately.

Intellectual Property

Any Content on Glosty may not be reproduces, distributed, transmitted, cached or otherwise used, except with the prior written permission of Glosty. This includes, but is not limited to, published articles and comments.

Glosty Rights

The entire content of Glosty, including all information, title, software, texts, displays, images, video, audio and the design, selection and arrangement thereof, are exclusively owned by Glosty. The Services are protected by copyright, and other laws of both the Australia and foreign countries. You have no right to the Glosty name or any of the Glosty trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Glosty, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions without any obligation to you.

Service Area

Glosty provides services for users in Australia only. While we are working on expanding Glosty services Australia-wide, it is currently only available in New South Wales.

Content on the Services

All Content, whether published or transmitted through private messages, is the sole responsibility of the person who created such Content. Any use or reliance on any Content posted via the Services or obtained by you through the Services is at your own risk.

You realize that by using the Services, you may be exposed to Content that might be offensive, inaccurate or otherwise inappropriate. Under no circumstances will Glosty be responsible in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind resulted by the use of any Content posted, emailed, or otherwise made available via the Services.

We (nor any of our respective directors, employees or agents) do not make any representation or warranty as to the accuracy, completeness, currency or reliability of the content and information contained on our Website (including in relation to products or services offered by third parties).

We reserve absolute right at all times to remove or refuse to publish any Content on the Services, to suspend or terminate users. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to.

We do not necessarily, support, sanction, encourage, verify, or agree with the comments, opinions, or statements posted by any user on Glosty. Nor do we or our third party service providers make any warranties as to any of the merchandise featured or mentioned on Glosty. Any Content, including advice and opinions, are the views and responsibility of those who post the statements.

Bookings

Glosty enables you to make bookings for services created by our hair professionals (“Vendors”).
When using services by our vendors, you acknowledge that the vendors will aim to replicate the results shown in the photos as closely as they can, however that may not be fully achievable at the provided cost based on different circumstances. You must inform your chosen vendor of your own circumstances (e.g your hair length, quality, colour and so on) and ask them to confirm the final cost before using the service. You must clarify all the details at the beginning of your appointment before the vendor starts the service.

The Vendors have a right to reject, cancel or modify your booking, including requesting additional cost to meet different circumstances, in their reasonable opinion. You must not use the services offered at Glosty or make a booking if you are aware that your circumstances are different.

When submitting a booking, you agree that you are submitting a request to the Vendor and that it is not an agreement between you and the Vendor. Vendors have the discretion to accept or reject the booking request or propose a different booking option. If you do not receive a confirmation of your booking, you must not attend it at the requested time, you must follow up with your Vendor for a confirmation. Any confirmation email or page that you see on Glosty merely indicate that your Booking has been received and is being reviewed by the Vendor. It does not necessarily mean that your booking has been accepted by the Vendor. You will need to receive an email clearly stating that your booking has been confirmed. We strongly encourage all our Vendors to accept all booking or to communicate any rejection promptly.

If you have any dispute with your Vendor, before, during or after the service was provide, you must resolve the dispute directly with the Vendor. Glosty will not intervene or provide mediation for any dispute between you and the Vendor.

Glosty doesn’t accept payments through the website, you must directly pay for the services to the Vendor after you receive the service.

If you are no longer available to attend your booking, you can cancel it no later than 72 hours prior to your booking start if you have a registered account. You can process the cancellation by logging into your account and submitting a cancellation. If you wish to modify your booking, you must contact the Vendor directly.

It is possible that some services on Glosty may include incorrect prices due to an error by our Vendors. We encourage you to confirm the service price before you receive the service.

Special Provisions applicable to Hair professionals (“Vendor”)

If you are a Vendor registered at Glosty, the following additional terms apply to you:

  • You will not provide any false personal information on Glosty, you commit to providing accurate information about you;
  • You will provide an accurate and up-to-date contact and workplace information;
  • You will not post photos that you have no permission to you or no intellectual property rights for;
  • You will not show third party ads without Glosty’s written permission;
  • You will agree and comply with the provisions of these Terms and Conditions.

Promotional Articles

Glosty may time to time publish Content on behalf of third parties. Glosty is moderated daily, and we reserve the right to refuse to post, or delete any articles without prior notice. However, we do not and cannot review all Content published on Glosty by users and we are not responsible for such Content.

Copyright Policy

Glosty respects the intellectual property rights of others and expects users of the Services to do the same. While writing articles, you will not copy any text from other sources without citing it. You agree that you will only post photos that you have intellectual rights for.

We reserve the right to remove any Content violating intellectual property rights without prior notice, and without liability to you. If necessary, we may also terminate a user’s account.

Ending these terms

You may end your legal agreement with Glosty at any time for any reason by deactivating your account.

We may suspend or terminate your Glosty account at any time for any reason, including, but not limited to, if there are reasonable signs of having violated these Terms and Conditions, and you activities create risk or possible legal exposure for us; or our provision of the Services to you is no longer commercially viable.

Limitation of Liability

GLOSTY DOES NOT WARRANT THE ACCURACY OF ANY CONTENT PUBLISHED OR TRANSFERRED THROUGH PRIVATE MESSAGES. THE CONTENT IS PROVIDED TO YOU “AS IS” AND ON AN “AS AVAILABLE” BASIS. YOU AGREE AND ACKNOWLEDGE YOUR RESPONSIBILITY FOR ASSESSING THE ACCURACY OF THE CONTENT AND RELY ON IT AT YOUR OWN RISK. WE ARE PROVIDING GLOSTY WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE CANNOT GUARANTEE THAT GLOSTY WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE. GLOSTY TAKES NO RESPONSIBILITY FOR THE ACTIONS, CONTENT OF THIRD PARTIES AND IT’S USERS, AND YOU RELEASE US, FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH GLOSTY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Amendments

We may modify these Terms and Conditions, for instance, reflect changes to the law or changes to our Services. If you continue accessing or using the Services it constitutes your acceptance of our amended terms.
